The Office of Open Records accepts Petitions for Reconsideration (PFRs) of its Final Determinations. An application for a PFR must be filed within 15 days after the issuance of a Final Determination. The application must be made by petition, stating specifically the grounds relied upon.
In the absence of applicable OOR interim regulations regarding PFRs, the OOR will follow the procedures set forth in Pennsylvania's General Rules of Administrative Practice and Procedure, 1 Pa. Code Section 35.241. Please refer to these rules to determine what effect filing this kind of petition may have on a PFR.
If the OOR grants a PFR, the respondent to the petition may file a response in the nature of an answer within 15 days of the issuance of the order granting reconsideration.
The OOR may deny a PFR in writing. Otherwise, a PFR will be deemed denied if no response is made within 30 days after it is filed.
