Request sought records related to the DA's Office selling forfeited vehicles and other property at auction. The Office demonstrated that the only procedures it follows are those set forth in the Controlled Substances Forfeiture Act and no other records exist. Regarding any other responsive records, the Office's evidence is conclusory in that it does not demonstrate an actual search. Under 42 Pa.C.S. §§ 5803(j) an annual audit sent to the OAG, is confidential, but the Act does not serve to make all underlying records confidential. While the DA referred the Requester to the OAG's website for the public audit report, if the Requester is unable to access or print the information, the Office must print the records and provide them to the Requester for any applicable duplication fees.
