Request sought a crime blotter data for a one week timeframe to include, type of incident, Date/time, and Location. The Requester had regularly been receiving the information by way of an Excel spreadsheet, due to the destruction of the agency's servers by
vandalism. The crime blotter information is now provided by the PD to a third-party website, Crimewatch. The City directed the Requester to the Crimewatch website. However, the user is subject to terms and conditions, including restrictive permitted uses. In addition, the data is not able to be downloaded. We find that directing the Requester to Crimewatch is not a sufficient response under Sec. 704, because the records are not fully available. The City demonstrates that the YCPD does not maintain the spreadsheets and that it was a temporary measure due to the loss of the City's server and it is not required to create a record. However, the information sought is maintained on the PD's system by the , which is used to transmit the information to Crimewatch, and the City has not proven that it is unable to extract the requested information in its possession to provide it to the Requester in an electronic format. Granted.
