Request sought certified, electronic copies of meeting minutes, as well as records related to the the street behind the Requester's house and the approval of a subdivision. Agency provided some records electronically on appeal, and met its burden of proving that no other responsive records exist in its possession, custody or control. Agency notified the Requester that the some of the records exist only as hard copies and are available for inspection. While the agency is not required to convert a record that only exist in a paper format into an electronic one, the request sought copies, and the agency must provide copies. The agency's certification of the records provided was inadequate, and upon payment of the appropriate fees, the agency is required to produce certified copies. Granted in part and denied in part.
