Although an appeal of the underlying request was originally filed on March 14, 2024, that appeal was dismissed for failure to include a copy of the request. See OOR Dkt. AP 2024-0722. On April 2, 2024, the appeal was refiled; however, by that time, the Requester’s time to appeal had elapsed. See OOR Dkt. AP 2024-0894. Thus, the Appeals Officer correctly determined that the appeal was untimely. The filing of the appeal at OOR Dkt. AP 2024-0722 did not serve to stay the appeal deadline.
