The Requests sought various records and communications concerning the Requester, his children, and ongoing issues with the Charter School within specified timeframes. The Charter School may withhold student medical records responsive to Request 4 pursuant to Section 708(b)(5). Records responsive to Request 5 are exempt pursuant to Section 708(b)(17). The Requester is entitled to records responsive to Request 1. Certain records responsive to Requests 2 and 3 are privileged. The Charter School has not demonstrated that the remainder of records responsive to Requests 2 and 3 are exempt under Section 708(b)(10). The Charter School has not demonstrated that certain responsive records do not exist in its possession, custody or control. The OOR declines to make a finding of bad faith.
