Case Status: Partially Granted/Partially Denied

Burns, Megan

Philadelphia

Request sought various records regarding soil, sediment, groundwater, surface water or other media sampling for per- and polyfluoroalkyl substances; uses, operations, spills or discharges involving aqueous film-forming foam ("AFFF"); trainings performed with AFFF; locations where firefighting training activities took place; locations where AFFF is/was stored; and the types, brand names, manufacturers or chemical compositions of AFFF purchased by or for, stored at and/or used at the Airport from 1965 to the date of the Request. Agency provided some records on appeal and demonstrated that most of the Request was insufficiently specific under Section 703 of the RTKL. Agency also proved that the disclosure of certain information is likely to endanger the safety or physical security of public infrastructure, and that other records are exempt under Section 708(b)(22) of the RTKL. However, to the extent that the records that were redacted by the Agency under the Copyright Act are not the same figures that are exempt under Section 708(b)(3)(iii), they must be made available to the Requester for inspection. Granted in part, denied in part and dismissed as moot in part.
